The terms under which Mama Haus is offered, the care we provide for your child, and how we look after your information.
Mama Haus (Pty) Ltd, registration number 2024/000000/07, with its registered address at 37 Glenhove Road, Melrose Estate, Johannesburg, 2196 ("Mama Haus", "we", "us", "our"). You can reach us at phumelele@mamahaus.net or on WhatsApp at 072 916 0488.
Mama Haus provides a coworking facility for mothers, with adjacent supervised childminding for babies and toddlers (0–3 years) by ECD-qualified, CPR-certified and First-Aid-trained nannies, while you remain on-site. We are not a daycare, crèche or drop-off care facility. The parent must remain in the building for the duration of their session.
Mama Haus offers month-to-month memberships (Core, Flex, Standard, Full and the equivalents for two children), single Day Passes (R395/day), and an Hourly Pass (R100/hour). The prices, day allocations and inclusions of each option are set out on our website and at the point of booking. We reserve the right to amend prices and inclusions on 30 days' notice to existing members.
A booking is confirmed when (a) we have received your booking request, and (b) where applicable, payment has been received or arranged. We will confirm bookings by WhatsApp or email, normally within 24 hours. Nursery capacity is limited and bookings are accepted subject to availability.
Payment is made via PayFast, EFT or in person on arrival, as agreed at the time of booking. Monthly memberships are billed in advance. Unpaid invoices that are 14 or more days overdue may result in suspension of access until paid.
For Standard Bank Private Banking clients, a 10% discount is applied to memberships, the Day Pass and the Hourly Pass when the booking is paid for using a Standard Bank Private Banking credit card. The benefit is verified in person on arrival or at first booking.
Day bookings may be cancelled or rescheduled up to 24 hours before the booking with no charge. Cancellations within 24 hours are non-refundable, but we will do our best to credit your booking to a future day.
Memberships may be cancelled on 30 days' written notice (email is sufficient). No refund is given for the unused balance of a current billing cycle. Memberships may be paused for up to one calendar month with prior notice; pauses beyond that are subject to availability.
Day Pass and Hourly Pass bookings follow the same cancellation rules as Day bookings above. If a member of a future month, your most recent Day Pass value can be credited to your first month's membership fee provided you join within 14 days of the visit.
Mama Haus is a calm, considered, child-present space. By using the space you agree to:
We reserve the right to refuse or end service, without refund, if you breach this code of conduct, behave abusively toward staff or other members, or do anything that compromises the safety of children in our care.
Use of the on-site childminding service is governed by Section B — the Childcare Support Annexure. By booking or attending, you accept those terms in full.
We may suspend or terminate your access immediately, without refund, if (a) you materially breach these terms, (b) you fail to pay an invoice that is more than 30 days overdue, or (c) your continued presence at Mama Haus presents a risk to the safety or wellbeing of children, staff or other members.
The Mama Haus name, logo, photographs, written content, website and brand identity are owned by Mama Haus and protected by copyright and trade mark law. You may not reproduce, redistribute or commercially exploit them without our prior written consent.
"Child" means a baby or toddler aged between 0 and 3 years (inclusive) attending Mama Haus in your care. "Parent" means you, as the legal parent or guardian of the Child, booking and paying for the service. "Childminding" means short-period, parent-on-premises supervision of the Child in our nursery while you work elsewhere in the building.
Mama Haus is a coworking space with on-site childminding. It is not a registered daycare, crèche or early-childhood-development centre. The Parent remains on the premises at all times, must be reachable, and must respond when called by Mama Haus staff. The Parent may collect, feed, soothe or visit the Child at any time during their session.
The Childcare service is offered to babies and toddlers aged 0 to 3 years (turning 4 in the calendar month of attendance ends eligibility). Children must be in reasonable health on the day of attendance — see Section 5 below.
Mama Haus undertakes to:
By bringing the Child to Mama Haus, the Parent warrants and undertakes that:
If a Child becomes unwell at Mama Haus, the Parent will be called immediately and asked to collect the Child from the nursery. If the Child requires urgent medical attention, Mama Haus will, in this order: (a) contact the Parent, (b) provide first aid where appropriate, and (c) where the Parent is unreachable or the situation is life-threatening, contact emergency medical services and the Parent's nominated emergency contact. The Parent authorises Mama Haus to do this and to bear reasonable medical costs incurred in good faith pending recovery from the Parent or the Parent's medical scheme.
From time to time Mama Haus may photograph or film the venue, including its members and children, for marketing purposes. Where a Child or member is identifiable, we will obtain the Parent's or member's prior consent on the intake form. You may withdraw consent in writing at any time, and we will remove the image from future use as soon as reasonably practicable.
The Parent acknowledges that, despite our reasonable care, the operation of childminding facilities involves inherent risks (minor injuries, illness transmission, normal toddler-to-toddler interactions). To the maximum extent permitted under South African law, the Parent indemnifies and holds harmless Mama Haus, its directors, employees, contractors and agents against any claim, loss or damage arising from or connected to the care of the Child, except where such loss is caused by the gross negligence or wilful misconduct of Mama Haus.
Nothing in this annexure excludes or limits Mama Haus's liability for death or personal injury caused by gross negligence or wilful misconduct, or any other liability that may not be excluded or limited under South African law (including the Consumer Protection Act 68 of 2008 and the Children's Act 38 of 2005).
We may refuse to admit a Child, or ask the Parent to collect the Child immediately, if (a) the Child appears unwell or symptomatic, (b) the Parent has not provided required disclosures or supplies, (c) the Child's behaviour poses a risk to other children in our care, or (d) the Parent has breached these terms. No refund is given in these circumstances.

We share your personal information only where necessary and with the following categories of recipient:
We do not sell your personal information to third parties.
Some of our service providers (notably Netlify and Google) are based outside South Africa, principally in the United States or the European Union. Where personal information is transferred outside South Africa, we ensure the recipient is bound by laws or contractual terms providing protection substantially similar to POPIA.
We retain your personal information for as long as you are a member or active customer, and for a further five years after the end of our relationship for legal, accounting and tax purposes, or longer if law requires. Child-related records (allergies, incidents) are retained for the period required by health and safety legislation.

Our website uses Google Tag Manager and may set analytics cookies (Google Analytics) and third-party advertising cookies (e.g. Meta Pixel). These are used in anonymised, aggregated form to understand how visitors use the site and to improve it. You can control cookies through your browser settings.
We take reasonable, appropriate technical and organisational measures to protect personal information from loss, misuse and unauthorised access. No system is perfectly secure; if we become aware of a breach affecting your personal information, we will notify you and the Information Regulator as required by POPIA.
We may update this policy from time to time. The "last updated" date above will change accordingly. If material changes are made, we will alert active members by email.
To the maximum extent permitted by South African law (including the Consumer Protection Act 68 of 2008), Mama Haus's total liability to you under or in connection with these terms, however arising, is limited in aggregate to the total fees you have paid to Mama Haus in the 12 months preceding the event giving rise to the claim.
Neither party is liable for indirect, special or consequential losses, including loss of profit, revenue, anticipated savings, business or goodwill, however arising. Nothing in this clause limits liability that cannot lawfully be limited under South African law, including liability for death or personal injury caused by gross negligence or wilful misconduct.
You indemnify Mama Haus, its directors, employees, contractors and agents against any claim, loss, damage or expense (including reasonable legal fees) brought by a third party arising from (a) your breach of these terms, (b) your conduct on the premises, or (c) any inaccurate information you provide, except to the extent caused by Mama Haus's gross negligence or wilful misconduct.
Neither party is liable for any failure or delay in performance to the extent caused by an event beyond its reasonable control (including fire, flood, power outage, telecommunications failure, pandemic, civil unrest, acts of government, or a closure ordered by a public authority). If such an event continues for more than 30 days, either party may terminate by written notice.
Nothing in these terms creates a partnership, joint venture, employment or agency relationship between you and Mama Haus. Neither party is liable for the debts or obligations of the other.
If any provision of these terms is held by a competent court to be invalid or unenforceable, the remaining provisions remain in full force. These terms, together with the Childcare Annexure, the Privacy Policy and any signed booking form, constitute the entire agreement between you and Mama Haus regarding your use of our services and supersede any prior understanding.
These terms are governed by the laws of the Republic of South Africa. The parties submit to the exclusive jurisdiction of the South African courts.
We may amend these terms from time to time. Material changes will be notified to active members by email no fewer than 30 days before they take effect. Continued use of Mama Haus after the effective date constitutes acceptance of the amended terms.
